ZBA failed country people

By:  Diane Benjamin

Last night the Zoning Board of Appeals, with slight modifications. approved yet another wind farm.

This is what the ZBA is charged with doing according to the County website:  (B) under Procedures    https://www.ecode360.com/13415648#13415648

The ZBA failed to protect the people living close to where this field will be built.  They had 8 hearings with experts only wanting the turbine setbacks from homes increased.  Invenergy wants to measure from your house, not the property line.  Since they can pack more turbines on the property, the ZBA allowed them to infringe on property they aren’t paying for.  The ZBA heard testimony from experts and people forced to move because of the noise.  Evidently, their testimony wasn’t important compared to how much tax revenue will be brought in.

Remember this pic?

I filed a FOIA request for text messages from Zimmerman and another Board member – Julia Turner.

Turner claimed there were no text messages.  Zimmerman claims he was looking up information on Wikipedia.  Shouldn’t he just ask questions instead of doing his own research?   What testimony did he miss while researching?

See the FOIA information I received Here

Now what committees recommend is irrelevant after the full Board decided they were smarter than the Land Use Committee on recycling, the entire Board needs to stand up for the citizens affected.

I bet they won’t ($$$$$).

  1. These are the standards I have been told they are supposed to follow and in my opinion clearly fails on 1, 2, 3, and 6:

    STANDARDS FOR RECOMMENDING
    1. The proposed special use will not be detrimental to or endanger the health, safety, morals, comfort, or welfare of the public.
    2. The proposed special use will not be injurious to the use and enjoyment of other property in the immediate vicinity for purposes already permitted or substantially diminish property values in the immediate area.
    3. The proposed special use will not impede the orderly development of the surrounding property for uses permitted in the district.
    4. Adequate utilities, access roads, drainage and/or other necessary facilities have been or will be provided.
    5. Adequate measures have been or will be taken to provide ingress and egress so designed as to minimize traffic congestion in the public streets.
    6. The establishment, maintenance and operation of the special use will be in conformance with the intent of the district in which the special use is proposed to be located.
    7. The proposed special use, in all other respects, conforms to the applicable regulations of the district in which it is located.

  2. Sue the ZBA and each member as an individual. That ought to get their attention. Can’t sue them ya say? Nonsense. This is still America and you can sue anybody for anything. Save the farmland!

  3. And guess what TEHY AIN’T making ANY MORE FARMLAND! These folks are just looking at REVENUE that they can spend to cover their ass on previous BAD decisions.
    TIME for this to STOP!!!

    1. And where were you when Bloomington was gobbling up East Side farm land for wealth realty developers to build above 3500 sq foot homes on that may very well be the next eye sores in our County as in no demand for them. Key word here,”Eyesores”.

  4. Diane I’m talking about every subdivision that has taken any farm ground since the 60 or 70’s. The fat cats started building wide instead of up. Up meaning high rise living to conserve farm ground now buried under concrete. But anytime a farm land owner does something on his own land, people get all worked up about food production. All this belly aching about dangerous situations is mostly just a cover for the real reasons to stop wind generator’s, Eyesores.
