Our Constitution is hailed a marvel of brevity and clarity. Following endeavors to provide both government & private citizen, alike, summary synopsis, article by article, amendment by amendment to better understand that which separates our FREE Sovereign Republic from all others in the world…not a democracy, rather a Republic… OF the people…BY the people…FOR the people, whereby citizens elect those WE choose to govern US and the right/power to recall-impeach-remove those who do not obey The Constitution.
THE CONSTITUTION OF THESE UNITED STATES, IN SUMMATION…
ARTICLE 1: establishes and authorizes the first of three branches of government the first the Legislature…
SECTION 1: authorizes the Congress a two-part body…Upper Chamber Senate & Lower Chamber House of Representatives.
SECTION 2: authorizes the Lower Chamber, House of Representatives, minimum requirements 25 year of age, duly registered legal citizen, two year term. House members divided among sovereign states, more citizens, more representatives. Speaker of House is Leader, selected by lower chamber members in majority. Lower Chamber controls the spending purse strings of our federal government.
SECTION 3: authorizes the Upper Chamber, Senate, minimum requirements 30 years of age, duly registered legal citizens, six year term. Each Sovereign State will have two duly elected Senators, regardless of population. This section introduces the Vice President, who is the leader of the Senate…called the President of the Senate, DOES NOT vote unless there is a tie.
SECTION 4: authorizes each Sovereign State citizens to duly elect those they choose to be their representatives district by district and mandates congress meet minimum once per year.
SECTION 5: mandates Congress must have minimum number of members present in order to meet, and set fines for members who do not show up, members may be expelled, each member must keep a journal to record proceedings and votes, neither house can adjourn without’ permission of the other.
SECTION 6: authorizes members of Congress be paid, stipulates they ‘cannot’ be detained while traveling to and from Congress, cannot hold any other office in government while in Congress.
SECTION 7: authorizes and stipulates how bills become law. FIRST, any bill raising taxes/fees must start out in the House…all bills must pass both House and Senate, in exact same form. Bills that pass both chambers are sent to President who can either sign the bill into law, or veto it and send the bill back to Congress, if both Chambers pass the bill by two thirds majority…bill becomes law over the presidents veto…known as ‘over-riding a veto.’ President options…if he neither veto’s a bill, nor, signs it, the bill becomes law w/out presidents signature after 10 days…SECOND, Pocket Veto, occurs if Congress sends the bill to the President and they adjourn, if the president does not sign the bill within ten days it becomes law.
SECTION 8: authorizes specific limited powers of Congress to establish and maintain a Military [Air force, Army, Navy], establish Courts of Justice to regulate commerce between sovereign states, declare war, establish Post Offices, raise taxes in support of aforementioned powers, including ‘Elastic Clause’ which allows Congress to pass any law necessary to carry out aforementioned limited powers ONLY.
SECTION 9: stipulates limits of Congress. Suspension of Habeas Corpus; Bills of Attainder; Ex Post Facto…laws are PROHIBITED. No law can give preference to one state over another, no citizen can be give preference over another, no business can be give preference over another. No monies can be taken from Treasury [TAX DOLLARS] except by duly passed law, No title of nobility, such as Prince of New York, will EVER be established by our government.SECTION 10: prohibits states’ from printing their own currency [money], or declare war in the name of the United States, or do most any other things prohibited by the Constitution and cannot tax goods from other states, nor can a state have a Navy.
ARTICLE 2: authorizes the Executive branch of three branches of our government.
SECTION 1: authorizes the office of President & Vice President, sets terms of office of four years. President elected by Electoral College, each state one vote for each member of Congress. Minimum 35 years old both president and vice president MUST be natural-born Citizens. President paid salary cannot change up or down, as long as in office, maximum eight years in office.
SECTION 2: authorizes President with limited important powers…Commander-In Chief of Military, Including National Guard. He has a Cabinet to aid him, which MUST be vetted and approved or not approved by The Upper Chamber Senate.
SECTION 3: authorizes presidential duties to give State of Union Address, make ‘SUGGESTIONS’ to Congress, act as head of state by receiving ambassadors and other heads of state, and be sure that the laws of the Republic of the United States under The Constitution & Declaration of Independence adhered to and carried out.
SECTION 4: authorizes the Constitutional procedures of impeachment to remove the president form office.
ARTICLE 3: authorizes the Judiciary branch of three branches of our government.
SECTION 1: authorizes the Supreme Court highest court of our Republic. Stipulates terms for Supreme Court and Lower Court of Judges to serve as long as they are on’ GOOD BEHAVIOR’, Judicate in accordance with The Constitution, usually for life. Judges can be impeached for misbehavior and/or non adherence to The Constitution. Authorizes Judges to be paid.
SECTION 2: authorizes the classification of cases that may be heard by the Federal Judiciary, which cases the Supreme Court is authorized to hear [called original jurisdiction], and all other cases heard by our Supreme Court are by ‘appeal.’ It also guarantees trial by jury in criminal court.
SECTION 3: unequivocally defines the crime of treason.
ARTICLE 4: concerns the state of our Republic.
SECTION 1: mandates all states’ will honor the laws of sister states of the Republic, for example…a married man & woman in Florida is also considered married in New York.
SECTION 2: mandates legal citizens in one state be treated equally/fairly as legal citizens of another state. Also citizen and/or illegal alien accused of a crime in one state who flees to another state, will be returned to the state they fled from wince they came. This section also applies to fugitive slaves which no longer applies.
SECTION 3: concerns the admittance of new states’ and the control of federal lands.
SECTION 4: unequivocally ensures a Republic form of government, a representative democracy [opposed to a dictatorial scheme]…each sovereign state derives its power from its citizens, not from a king, nobility, elitists or otherwise…The Republics federal government will protect states’ against invasion and insurrection.
ARTICLE 5: the method of amending, or changing The Constitution. See Amendments’ Page.
ARTICLE 6: concerns the State of our Republic. First it guarantees the United States, under The Constitution, will assume all debts and contracts entered into by the United States under ‘Articles of Confederation.’ It sets The Constitution and all laws and treaties of the United States to besupreme law of the country. Finally, it requires all elected and/or appointed officials and/or officers [including Military , Police, Government Employees] of the United States to ‘swear an oath of ALLEGIANCE to the Republic of the United States and The Constitution when taking and during office…SO HELP ME GOD, MANDATORY.
ARTICLE 7: details method for ratification [acceptance] of The Constitution of the original thirteen states’ , nine had to accept, two thirds] The Constitution before it went into effect, today we are 50 sovereign, yet, United States.CONSTITUTIONAL AMENDMENTS, THE BILL OF RIGHTS: First ten amendments were all adapted at the same time 1791, collectively today twenty-seven known as The Bill of Rights which are absolute…
1st Amendment Freedom of Speech [1791]…Congress shall make NO Laws respecting an establishment of Religion, or prohibiting the free exercise thereof, or abridging the Freedom of Speech, or the press [news media], or the right of the people peaceably to assemble, and to petition [challenge] government for ‘A REDRESS of GRIEVANCES. Protects Citizens absolute rights to: Religion-Speak Freely-Assemble [meet]-Challenge [address] government and news media to publish freely without interference from government. Any elected and/or appointed government official who attempts to ignore this amendment subject to impeachment, removal from office.
2nd Amendment Freedom to Protect [1791]…‘A well regulated Militia, being necessary, to the security of a FREE State, the right of the People to Keep & Bear Arms…shall NOT be Infringed. Elected or appointed
government official who ignore this amendment subject to impeachment, removal from office.
3rd Amendment [1791]…guarantees citizens the Military cannot force Homeowners to give them room and board.
4th Amendment [1791]…protects citizens from overreaching government, improperly taking property, papers, or people without a valid warrant based on probable cause [good reason].
5th Amendment [1791]…protects people from being held for committing crime, unless indicted, may not be tried twice for same crime, not be forced to testify against ones self, no property being taken w/out just compensation.
6th Amendment [1791]…guarantees a speedy trial, an impartial jury, that the accused can confront witnesses against them, the accused must be allowed to have legal representation.
7th Amendment [1791]…guarantees jury trial federal civil court cases, normally no longer heard in federal court.
8th Amendment [1791]… guarantees punishment be fair, not cruel, extraordinarily large fines will not be set.
9th Amendment [1791]…states other rights, aside from those listed herein, may exist, though they are not listed, does not mean they can be violated.
10th Amendment [1791]…states any power not granted to the federal government…belongs to the States’ or Citizens of Sovereign States.
11th Amendment [1795]…clearly defines the original jurisdiction of our Supreme Court concerning a suit brought against a state by a citizen of another state.
12th Amendment [1804]… redefines how the president and vice president are chose by the Electoral College, making the two positions cooperative, rather than first and second highest vote-getters. It also ensures anyone who becomes vice president…must be of natural birth citizenship to be president.
13th Amendment [1865]…abolishes slavery in the Republic of the United State.
14th Amendment [1868]…ensures equal rights of legal citizens at the federal and state levels, remove three-fifths slave counting in census, ensures US will not pay debts of rebellious states, who veer from The Constitution. Includes several measures to ensure loyalty of both legislators of North & South.
15th Amendment [1870]…ensure/mandates race will not be used as a criteria for voting.
16th Amendment [1913]…permits the United States to collect income tax without regard to population of states.
17th Amendment [1913]…shifted choosing senators from state legislatures to legal citizens of the states.
18th Amendment [1919], repealed by Amendment 21 [1933]…abolished the manufacture and/or sale of alcohol in the United States.
19th Amendment [1920]…ensures gender [male-female]cannot be used as a criteria for voting.
20th Amendment [1933]…sets terms for president & vice president shall end on the 20th day of January, senators & representatives on the 3rd day of January, of the years in which such terms end…clarifies how death of a president before swearing in is handled.
21st Amendment [1933]…repeals the 18th Amendment.
22nd Amendment [1951]…sets term limits for a president, maximum two 4 year terms., exception for VP who assumes presidency after death or removal of president from office = maximum term of ten years.
23rd Amendment [1961]…authorizes Washington District of Columbia right to vote in presidential election.
24th Amendment [1964]…ensures NO TAX will be charged to vote in any government elections.
25th Amendment [1967]…clarifies the line of succession to the presidency, establishes rules for a president who becomes unable to perform duties while in office.
26th Amendment [1971]…ensures any law abiding legal citizen 18 years or older the right to vote.
27th Amendment [1992]…require any law increasing pay of legislators may not take effect until after election and made public knowledge to citizens, prior to law enactment.
