Update: 2nd Amendment: Where’s McLean County?

Does the Constitution matter or not?   The right of the people to keep and bear arms shall not be infringed.

(Militia meant every person capable of using a gun, don’t try that argument here)

Illinois Constitution: 

Article One, SECTION 22. RIGHT TO ARMS
    Subject only to the police power, the right of the individual citizen to keep 
and bear arms shall not be infringed.

Article IX, SECTION 1. STATE REVENUE POWER
    The General Assembly has the exclusive power to raise revenue by law except 
as limited or otherwise provided in this Constitution. The power of taxation shall 
not be surrendered, suspended, or contracted away.

As asked by a citizen of Illinois, don’t taxes infringe on the right to arms and ammunition?

He recently bought a gun in Decatur and paid 9.25% Sales Tax.

Cities and Counties all over central and southern Illinois are passing resolutions to protect the rights of citizens given in both the US and Illinois Constitutions.

New gun control laws only affect people NOT breaking the law. They will do nothing except “infringe” on the rights of law-abiding citizens.

When some people don’t believe life matters, they will kill by whatever means is handy.  Ban guns and they will use knives, vehicles, bombs or whatever sick method they can concoct.  Our society is sick, gun laws won’t fix that problem.

Christian, Effingham and Shelby counties have adopted gun sanctuary resolutions, many others are discussing it.

Where is McLean County?

I don’t know because my reps haven’t answered me yet.

    ” Subject ONLY to the police power, the right of the individual citizen to keep and bear arms shall not be infringed.” It states, “Subject ONLY to the police power.”
    Webster’s definition of “only”- nothing more, solely, or exclusively. It doesn’t say subject only to the police power and sales taxation, it says subject ONLY TO THE POLICE POWER, NOTHING MORE!

      “The General Assembly has the exclusive power to raise revenue by law EXCEPT AS LIMITED or otherwise provided IN THIS CONSTITUTION. The power of taxation shall
      not be surrendered, suspended, or contracted away.” It’s quite clear, article 1, section 22 “Subject ONLY(solely) to the police power” limits the state from lawfully applying sales tax to guns & ammo (arms). None of our constitutionally protected rights, in the Illinois constitution’s Bill of Rights can be lawfully taxed. I bet a non-thinking persons like you think the state has the lawfully authority to tax our constitutionally protected rights of free exercise of religion and free speech too.

  2. “The General Assembly has the exclusive power to raise revenue by law EXCEPT AS LIMITED or otherwise provided IN THIS CONSTITUTION” clause in art 9, section 1 was added to keep the state from having the pretense of the lawful authority to tax our constitutionally protected rights listed in the Bill of Rights.

  3. Diane:
    You need to warn the counties and cities considering these resolutions TO BEWARE of lawyer attacks such as what happened in Clark and Shelby counties to force the boards to remove the word “sanction”.
